Your privacy is important to Mako International LLC (“Mako”), and we go to great lengths to protect it. This Privacy Policy applies to the online collection of personal information via software and Internet services and is incorporated into any agreement between you and Mako, and the Terms of Use for the website, which are found at hammerheadswimcaps.com (“Site”), and likewise incorporated herein by reference. This Policy does not apply to information collected in any other way.

The Site, your use of the Site, and your interest in or purchase of products from Mako, constitutes the “Services.” The Services may contain links to sites maintained by others. This Privacy Policy does not reflect the privacy practices of those sites. By using the above Services, you consent to the terms of this Privacy Policy and to Mako’s processing of personal information and non-personal information for the purposes provided in the Privacy Policy. You further consent to reviewing the Privacy Policy from time to time to view any updates.

WHAT PERSONAL INFORMATION DOES MAKO COLLECT AND HOW DO WE USE IT?

We collect information about our users in three ways: directly from the user, from our web server logs, and through cookies. We use the information primarily to provide you with a personalized Internet experience that delivers the information, resources, and services that are most relevant and helpful to you. We don’t share any of the information you provide with others, unless we say so in this Privacy Policy, or when we believe in good faith that the law requires it.

User-Supplied Information

Mako may make websites available to you for chat rooms, forums, message boards, or news groups. Please remember that any information disclosed in these areas is public. You should exercise caution when disclosing personal information in these areas. Don’t disclose information in these public forums that might be considered confidential.

Social Media Interactions and User Generated Content

Mako invites you to socialize and share your purchases with others using Social Media tools such as Facebook, Instagram, Twitter, Google+, YouTube, etc. If you choose to use these tools, you may be sharing certain profile elements, including your comments. This sharing is subject to each social media program’s privacy policies. We offer links on our site to “Share” or “Like” our site or products for many of the popular social sites. To remove a “Share” or “Like” or to delete your comments you will have to make those changes directly on that specific social site.

We may permit users to share their own content (“User Generated Content”) on our site. This User Generated Content may include but is not limited to video, audio, photographs, images, illustrations, animations, logos, written posts, replies, comments, information, data, text, and graphics. You acknowledge that you have no expectation of privacy as to any User Generated Content on our site.

Cookies

The Services are not structured nor intended for users under 18 years of age. HOW DOES MAKO PROTECT THE PERSONAL INFORMATION THAT IT COLLECTS?

We have implemented certain appropriate security measures to help protect your personal information from accidental loss and from unauthorized access, use, or disclosure. For example, we use a variety of technical security measures to secure your data. In addition, we use intrusion detection and virus protection software. However, please note that we cannot guarantee that unauthorized persons will always be unable to defeat our security measures.

Also, please note that we may store and process your personal information in systems located outside of your home country. However, regardless of where storage and processing may occur, we take appropriate steps to ensure that your information is protected, consistent with United States laws, and the principles set forth under this policy.

WHO HAS ACCESS TO THE PERSONAL INFORMATION?

We will not sell, rent, or lease mailing lists or other customer data to others, and we will not make your personal information available to any unaffiliated parties, except as follows:

HOW MAY I CORRECT, AMEND, OR DELETE MY PERSONAL INFORMATION AND/OR UPDATE MY PREFERENCES?

You may cancel your account or update your preferences at any time. If you don’t want to receive information about our products or services, please update your account preferences (where available), check the appropriate box when registering, and/or utilize the “unsubscribe” mechanism within the communications that you receive from us.

Deletion of User-Generated Content

On termination of your account, or upon your deletion of particular pieces of User-Generated Content from the Services, Mako shall make reasonable efforts to make such User-Generated Content inaccessible and cease use of it; however, you acknowledge and agree that: (a) removed User-Generated Content may persist in caches or backups for a reasonable period of time and (b) copies of or references to the User-Generated Content may not be entirely removed (due to the nature of reblogging or reposting, for example).

CALIFORNIA RESIDENTS

If you are a California resident and have an established business relationship with us, you can request a notice disclosing the categories of personal information we have shared with third parties, for the third parties’ direct marketing purposes, during the preceding calendar year.
